Legality of cannabis consumption in Spain
Cannabis consumption is not punishable in Spain, so buying marijuana is not illegal.
Neither is it punishable by criminal prosecution, but it is punishable by an administrative fine of between 300 € and 3000 € for consumption and/or possession of cannabis in public. In general, the authorities keep penalties at the lowest level and it is rare that a fine for possession or consumption of cannabis in public exceeds €450.
At the end of 2013, the draft Law for the Protection of Public Safety was presented in which the penalties for possession or consumption of cannabis in public were increased to €1000, removing the possibility of replacing fines with detoxification treatment.
